Competition Bureau starts consultations on new “greenwashing” provisions

Canada’s competition bureau announced the start of public consultations to inform the development of an “enforcement guidance” framework around environmental claims.

Lawmakers last month amended the Competition Act to prohibit companies from making deceptive claims about the environment. The move has been controversial, with companies arguing the provisions are unclear and require them to substantiate claims with an “internationally recognized methodology” that hasn’t yet been defined in the law.

The competition bureau said it will be taking feedback until Sept. 27.

“The Competition Bureau has received a large number of requests for guidance on the interpretation of new provisions of the Competition Act aimed at greenwashing,” Matthew Boswell, commissioner of the bureau, said in a statement released on June 22. “Through our consultation on these new provisions, we will provide guidance that will offer transparency and predictability for Canadians.”
